The Construction (Design and Management) Regulations 2015 apply to most domestic building projects. Here is what homeowners need to know about their legal duties.

When CDM applies

CDM 2015 applies when: the project involves more than one contractor working simultaneously; or the project lasts more than 30 working days with more than 20 workers; or total person-days exceed 500.

Your duty as domestic client

As a domestic client, you can transfer your CDM duties to your Principal Contractor. This transfer happens automatically when you appoint a single contractor. Your principal contractor then takes on responsibility for: producing a Construction Phase Plan before work starts; ensuring health and safety is managed on site; producing a Health and Safety File at project completion.

Pre-Construction Information

Provide your contractor with any information you hold about the property — asbestos surveys, structural reports, drainage plans, previous works.

The Health and Safety File

At the end of the project, your principal contractor should hand you a Health and Safety File — containing as-built drawings, materials specifications, and maintenance instructions. Keep it. You will need it if you sell the property or do further works.
